The 1991 U.S. Federal Sentencing Guidelines state that senior officials must perform their duties with the same care that ordinary sensible people would exercise under similar circumstances. The Federal Sentencing Guidelines were augmented in 1997 to apply to computer crime. Under these guidelines, senior corporate officers can be personally subject to up to $290 million in fines if their organizations do not comply with the law.
The standard criteria for assessing the legal requirements for implementing recommended safeguards is to evaluate the cost of the safeguard and the estimated loss from the corresponding threat and the probability of the occurence of the threat, if realized. If the cost is less than the estimated loss and the organization doesn’t implement the safeguard, then a legal liability may exist, in which an action taken or not taken was part of a sequence of events that resulted in negative consequences. |
